Fitness to stand trial
A fitness to stand trial assessment is made when a judge wants to determine whether or not the accused is “unfit to stand trial” and if they should send the accused to be assessed by a psychiatrist.
Fitness hearings
After the accused has been assessed by a psychiatrist, they will return to court so that a judge can decide whether or not the accused is “unfit to stand trial”.
Treatment orders
A treatment order, which is made by a judge, requires an unfit accused to be made fit to stand trial through psychiatric treatment. It is a unique circumstance where the accused does not have a choice in receiving treatment.
